User Behavior Policy

 

  1. Purpose and basis

This document describes the main principles, criteria, and guidelines for permitted behavior of Users when using the services provided by Hoster Expert. The User Behavior Policy (UBP) aims to comply with Estonian and European Union legislation, ensure network security and availability, protect Users’ privacy, and control other factors affecting the provision of services.

Hoster Expert reserves the right to determine the rules and restrictions for Users using the services.

The UBP is not an exhaustive and final list. Hoster Expert reserves the right to change the UBP without notice if necessary. Changes take effect from the moment the updated UBP is uploaded.

Violation of the UBP may result in the suspension/termination of services for the User or the implementation of other measures that Hoster Expert deems necessary.

In the event of service suspension or termination due to a violation of the UBP, no adjustments will be made.

  1. Hoster Expert imposes the following prohibitions on activities:

2.1. Spam / email marketing

Hoster Expert strictly follows a zero-tolerance policy towards spam, unsolicited messages, and intrusive advertising. These activities involve sending unsolicited/intrusive emails with identical or similar content to multiple addresses.

A message is considered unsolicited/intrusive if the recipient has not subscribed to it or expressed a desire to receive such messages, or if it violates the rules of a forum or newsgroup, except when it concerns a legal entity’s general email address associated with a specific company domain. In any case, it is forbidden to send messages to addresses provided by free service providers (gmail, Hotmail, etc.), even if that address is used as an official email address in the business register.

This point also includes the use of fake email headers or false contact information.

It is also prohibited to generate spam with other providers, which may give the impression of a connection with Hoster Expert, regardless of whether the message was sent from our network or not.

Unblocking. If, due to the User’s actions, Hoster Expert’s mail servers or IP ranges end up on a blacklist or are subject to email filtering used on the internet, a one-time fee of €50 + €50 per hour for the administrator’s working time spent on removing servers and IP ranges from the blacklist and ensuring their protection will be added to the User’s account.

Mass mailings. Sending mass mailings is considered spam. All messages sent to individuals who have not clearly expressed a desire to receive information from Hoster Expert’s User are deemed unsolicited. Mass mail senders must keep complete and accurate records of all individuals who have requested to receive emails from them. All evidence confirming the sending of messages (including email content and headers) must be preserved and provided to Hoster Expert upon request.

If the User cannot provide confirmatory documents, the recipient’s complaint will be considered evidence that they did not agree to receive the message, and therefore it will be considered unsolicited.

Mailing lists and group postings. Mass mailing rules also apply to mailing lists and group postings. Only those postings directed to a specific target audience who have voluntarily subscribed or provided their email address to the User for receiving information are allowed. The mailing list or group posting must allow automatic opt-out and ensure that no more emails are sent to the given address.

 

2.2. Hacking or exploiting security vulnerabilities.

2.3. Exploiting or combating security vulnerabilities.

2.4. Unauthorized access to any server or system, including hacking, theft, or scanning of other Hoster Expert accounts.

2.5. Deliberate distribution of offensive content, including threats, libel, uncensored or discriminatory information-containing messages.

2.6. Presenting sexual images involving minors or other activities that may harm children. The use of Hoster Expert’s services for storing, sending, displaying, transmitting, or providing access to child pornography is strictly prohibited. Hoster Expert will immediately notify the police if it is discovered that Hoster Expert’s network is being used for storing or transmitting child pornography.

2.7. Fraud.

2.8. Violation of privacy.

2.9. Infringement of intellectual property rights, including copyrights, trademarks, patents, as well as the storage, use, and distribution of pirated material.

2.10. Use of third-party software without an appropriate license or consent.

2.11. Network attacks or attempts to disrupt the service or operation of another network server.

2.12. Spreading viruses, malware, or other harmful code.

2.13. Any illegal activity.

2.14. Use of Internet chats (IRC). Hoster Expert allows the use of autonomous IRC servers that are not connected to global IRC networks, such as Undernet, EFnet, DALnet, and other IRC networks. IRC servers connected to global IRC networks are considered a violation of the terms of use.

2.15. If the User’s service causes a DoS or DDoS attack that disrupts or prevents the provision of services to other users, Hoster Expert will suspend the service with the aim of ensuring the provision of quality services to other users within the Hoster Expert network.

  1. Adult content:

Hoster Expert allows the storage of adult content on its servers, provided it does not violate the laws of the Republic of Estonia and the European Union, and provided it does not violate the terms of use in any other way.

It is important to remember that the storage and distribution of adult content must comply with national legislation and local regulations and not infringe on the rights of third parties. Users of Hoster Expert services must comply with all relevant laws and standards and consider the applicable age restrictions for such content.

In case of discovering violations related to adult content, Hoster Expert reserves the right to take appropriate measures, including blocking access to materials or terminating the provision of services.

In conclusion, using Hoster Expert services means complying with all the above rules and restrictions. Non-compliance with these rules may result in the termination of services or the implementation of other sanctions applied by Hoster Expert. Users are responsible for their actions and all content that they store, transmit, or distribute using Hoster Expert services.

  1. Reporting Violations

Hoster Expert requests that anyone with information about a violation of their terms of service report it immediately by sending an email to abuse@hosterexpert.ee.

If you discover a violation of your intellectual property rights, including copyrights, trademarks, or patents, please contact the infringing party and request that the offending content be removed immediately. If the infringing party refuses to correct the violation or does not respond to you within a reasonable period of time, please notify Hoster Expert at abuse@hosterexpert.ee. The email should include information about how you attempted to contact the infringing party and the results of that communication. Additionally, provide details about the materials in question located on our servers (material name, domain, or IP address where it is located). Finally, provide official confirmation that you own the specific intellectual property rights in question.

Hoster Expert will disregard any intellectual property claims that do not meet the above requirements.
